Our Definitions

We have provided the following partial extract from our Policy Wording, so you can readily check the special meaning we attach to certain words and phrases in our Policy terms and Conditions. You should always refer exclusively to our policy wording document for a complete understanding of the Terms and Conditions that apply to KidsFirst insurance.

‘Accident’ and ‘Accidental’

A sudden identifiable violent external event which happens by chance and which could not be expected; or unavoidable exposure to severe weather.

‘Activities of Daily Living’

  • grasping a small object such as a pencil or a coin with either hand;
  • picking up, from knee height, a 2 kilogram weight with either hand and carrying it for 5 metres;
  • bending or kneeling from a sitting or standing position to pick something light off the floor;
  • standing up, without assistance, from an armless dining room chair;
  • ascending and descending a flight of 12 stairs, with 2 feet on each stair if required;
  • walking on a level surface for 200 metres without having to stop;
  • standing, without support, for 20 minutes;
  • carrying out your usual daily routine without suffering from fits and blackouts on a regular basis, based on reasonable medical opinion;
  • getting into or out of a car or to board or alight from public transport or to use your usual mode of transport.

‘Air Sports’

Any aerial pursuits or sports including but not limited to the following: ballooning; bungee-jumping; gliding; hang-gliding; micro-lighting; parachuting; paragliding; or parascending.

‘Benefit Amount’

The maximum amount We can pay based on the level of cover the Insured Person has at the time of the Accident as shown in the Policy Schedule.

‘Benefit Period’

The maximum, but not necessarily consecutive, period for which benefit is payable as shown in the Policy Schedule.

‘Bodily Injury’

Injury to an Insured Person which happens while the Policy is in force which is caused only by an Accident and, on its own, leads to Temporary Total Disablement.

‘Business Sponsor’

The Company or organisation, shown in the Policy Schedule, with whom We have worked to present this Policy to You.

‘Child, Children’

An insured person’s offspring, extending to include a step child or children and a legally adopted child or children, each of whom must be (a) under 18 years old (or under 23 if in full time education) (b) dependant on You or your Partner even if he or she does not live with either of you; and (c) unmarried.

‘Commencement Date’

The day, month and year shown in the Policy Schedule for the cover to start.

‘Contract Worker’

An Insured Person who at the Commencement Date, or Effective Date if later: is Employed on a fixed term contract of Employment with a minimum duration of 12 months and having at least 6 months to expiry; and has been in Employment for the preceding 24 months.

‘Control’ and ‘Controlling’

Having the power to influence a company’s affairs including, but not limited to, owning the majority share capital or voting rights or by powers given in any recognised document.

‘Deferment Period’

The number of days at the beginning of any period of Temporary Total Disablement, as stated in the Policy Schedule, which must be exceeded before any benefit becomes payable.

‘Effective Date’

The day, month and year shown in the Policy Schedule for any change in cover to start.

‘Employed’

In Employment.

‘Employment’

Any remunerated and permanent work, Self-Employed or otherwise, of at least 16 hours per week.

‘Gross Income’

The gross salary or wages earned per annum by the Insured Person as remuneration for services provided immediately preceding the date of Temporary Total Disablement excluding loans whether repayable or otherwise, benefits in kind, profit share payments, overtime or expenses payments unless these emoluments have been specifically included in the Insured Person’s P.60 by the Insured Person’s employer.

‘Hazardous Activities’

The following activities: Air Sports or Winter Sports; underwater swimming or diving using any type of equipment to aid breathing; climbing or mountaineering where the use of ropes or guides would reasonably be expected; pot holing; professional sports; or racing unless this is on foot.

‘Illness’

Sickness or disease contracted by an Insured Person which: commences while this Policy is in force; and on its own, leads to Temporary Total Disablement.

‘Insured Person’

You and your Partner if they are shown as insured in the Policy Schedule.

‘Ireland’

The island of Ireland and its islands except the area defined as Northern Ireland in the Government of Ireland Act 1920.

‘Irish’

Of or pertaining to Ireland.

‘Joint Cover’

An arrangement where the policy covers the Principal Policyholder and their Partner and in the event of a claim, the Monthly Amount payable to an Insured Person is calculated on a pro rata basis in relation to the Normal Incomes of both the Principal Policyholder and their Partner.

‘Monthly Benefit’

  1. Where Individual Cover or working parent and ‘stay at home’ parent Cover has been chosen:
    1. The maximum monthly amount We can pay based on:
      1. the level of cover an Insured Person has at the time of the Temporary Total Disablement as shown in the Policy Schedule; or
      2. 75% of the Insured Person’s Normal Income as verified by Us in the event of a claim; whichever is the lower; this does not apply to the ‘stay at home’ parent benefit.
    or
  2. Where Joint Cover has been chosen:
    1. The maximum monthly amount We can pay based on:
      1. a pro rata of the monthly amount shown in the Policy Schedule in relation to the Normal Incomes of the Principle Policyholder and their Partner (who must also be an Insured Person); or
      2. 75% of the Insured Person’s Normal Income as verified by Us in the event of a claim; whichever is the lower.

‘Normal Income’

  1. In respect of Insured Persons who are Employed - the average monthly income received from their employer in the twelve months immediately prior to their claim.
  2. In respect of those who are Self Employed - the monthly average of the annual income they declared to the Revenue Commissioners on their self-assessment tax return for the previous tax year (the tax year immediately prior to the tax year in which the claim occurs).

‘Parent or Legal Guardian’

A person with parental responsibility, or a legal Guardian, both being in accordance with the Children Act 1989 and any statutory amendment modification or re-enactment of it.

‘Partner’

Your spouse, or somebody with whom you have been living as if they were your spouse (includes same sex partners), or a Parent or Legal Guardian of Your Children, as named in the Policy Schedule.

‘Permanently Resident’

Resident in the first instance for at least three months and thereafter for forty weeks on average each year.

‘Permanent Total Disablement’

Disablement which has lasted at least 12 months from which ACE believe the Insured Person will never recover and which stops the Insured Person from carrying out gainful employment of any and every kind.

‘Plan’

Kids First Insurance Plan.

‘Policyholder’

An Insured Person.

‘Pre-existing Medical Condition’

Illness or injury for which an Insured Person has, or should reasonably have, received relevant medical treatment or advice by a Qualified Medical Practitioner during the 24 months immediately before the Insured Person’s initial Commencement Date or Effective Date if later.

‘Principal Policyholder’

The person named in the Policy Schedule who has taken out the Policy.

‘Qualified Medical Practitioner’

A doctor or specialist, registered or licensed to practise medicine under the laws of the country in which they practise who is neither: an Insured Person, or a relative of such Insured Person unless approved by Us.

‘Self Employed’

An Insured Person is: a partner in a business partnership; or helping with, managing, or carrying out any part of the day-to-day running of a business in Ireland and are liable to pay class S Pay Related Social Insurance (PRSI) contributions in Ireland; or a company director who is a Controlling director as defined in Company Law of Ireland; or a person who exercises direct or indirect Control over a company (not necessarily the majority shareholder or holder of the majority voting rights); or working for a company and in any way connected with a person who has Control (as referred to above) over that company (for example, an Insured Person is one of his or her family).

‘Temporary Total Disablement’

Illness or Bodily Injury which, in the opinion of, and whilst being under the regular care and attendance of, a Qualified Medical Practitioner: 1. in the case of an Insured Person who is in remunerated employment - temporarily stops them from doing their normal occupation or any similar occupation. It must also stop them from doing any other occupation which their experience, education or training reasonably qualifies them to do; or 2. in the case of an Insured Person who is Self-Employed - stops them from helping, managing or carrying out any part of the day-to-day running of a business; or 3. in the case of an Insured Person who is not in remunerated employment the Illness or Bodily Injury must temporarily stop them from being able to perform any three of the Activities of Daily Living.

‘We’, ‘our’, ‘us’

‘Winter Sports’

Any winter pursuits or sports including, but not limited to, the following: skiing (including skiing outside the area of the normal compacted snow ski slope i.e. ‘off-piste’); tobogganing; snow boarding; ice skating (other than on an indoor rink); ski or ski bob racing; mono skiing; ski jumping; ski boarding; ice hockey; or the use of bobsleighs or skeletons.

‘You’, ‘your’

The person named in the Policy Schedule as the Principal Policyholder who has taken out the Policy.
